Terms of Service

Please read these Terms of Service carefully before using the official "SolarMiner" App (hereinafter "Software").

1. Open Source & Trademark Licensing

The source code of SolarMiner is licensed under the GNU Affero General Public License v3.0 (AGPLv3). You have the right to inspect, modify, and run the code according to this license. However, the name "SolarMiner" and its logos are protected trademarks. Using the official, compiled SolarMiner releases or using the SolarMiner name implies acceptance of our specific usage model outlined below.

2. Usage Model & Developer Fee (Dev Fee)

  • Free Provision: Downloading and using the software is generally free of charge. There are no fixed costs or subscriptions.
  • Developer Fee (Dev Fee) in two tiers: Remuneration for the usage and automation performance of the software is based on a hashrate levy model. As soon as miners are registered in the software, a share of the total hashrate controlled by the software is automatically redirected to the developer's wallet. The standard share is 2.5 %. It drops to the reduced proxy tier (currently 1 %) while the SolarMiner PC-Agent runs without a SolarMiner Node — i.e. without the software steering your energy and PV automation. As soon as a SolarMiner Node steers or reads the agent, or Node control is enabled in the PC-Agent, the software automatically and immediately switches back to the full automation rate. The exact percentage is defined centrally by the SolarMiner fee backend and is always transparently readable inside the software; it may change without any action required from you.
  • Referral codes: Referred users may pass part of the dev fee to a referrer through referral codes. Depending on the code, the fee split may shift or the total fee may even decrease; the live split displayed in your software always governs.
  • Modification & Trademark Enforcement: The official SolarMiner releases include this mandatory pool configuration. While the AGPLv3 license grants you the right to modify the source code (including removing the fee mechanism), doing so means you are creating a modified fork. In accordance with our TRADEMARK.md, if you alter or bypass the Dev Fee, you must immediately remove all SolarMiner branding, logos, and names from the software. You may not operate a modified, fee-bypassed version under the name "SolarMiner".
  • Lightning Fees: The use of Lightning functionalities may be subject to fees charged by the third-party provider phoenixd (ACINQ). These fees are not collected by us and are to be borne by the user.

3. Disclaimer of Liability

  • Use at Your Own Risk: The software intervenes in sensitive, high-value hardware (ASIC miners) and electrical infrastructure (photovoltaic systems/inverters). Use is entirely at the user's own risk.
  • Exclusion of Hardware Damage: We are not liable for damage to miners, power supply units, control units, inverters, home batteries, or other components resulting from dynamic hashrate scaling, automated control commands, or software errors.
  • No Earnings or Profit Guarantee: Crypto mining is subject to volatile factors such as network difficulty, Bitcoin prices, pool availability, and weather conditions. We assume no liability for lost profits, insufficient mining yields, or financial losses.
  • Responsibility for Third-Party Providers: The registration and use of external mining pools (e.g., for the correct operation of the software) is the sole responsibility of the user. We are not liable for errors, outages, or withholdings by the pools used.
  • Liability for Lightning Functionality:
    • The integration of phoenixd is provided "as is". We do not guarantee the availability or error-free operation of the Lightning node.
    • We assume no liability for the loss of Lightning funds due to user error, bugs in the third-party software, incorrect channel configurations, or loss of backup data (seed).
    • The user is obligated to perform regular backups of their node. Data loss of the local phoenixd database leads to the irrevocable loss of Lightning funds.
    • The correctness of payment addresses (BOLT11/BOLT12) is the sole responsibility of the user. We are not liable for misdirected payments.
  • Socket Operation: The user is responsible for configuring network connections (socket connection to the backend). Deactivating the socket connection limits functionality (removal of LNURL), of which the user must be aware.

4. Testing Period & No Refund Policy

The Solar Miner App is provided as "free-to-use" software. Users have the opportunity to fully test the software in its free version before deciding to use it on a long-term basis. Since the software can be fully evaluated before use, there is no "money-back" guarantee. By using the software, the user acknowledges and agrees that there are no refund claims for any mining shares generated through the developer fee or any licenses bought for this software.
